Force Majeure: is a French term that means” greater force”. It is the act of God, a natural catastrophe that no person can prevent because it is caused by nature. No one has any control over the event, it is an unexpected and unforeseeable event such as an earthquake, flood, volcanic eruption, tornado, war, revolution, or labor strike. An event in which no party shall be accountable. Force majeure is a common clause in the contract. Act of God is an excuse for delaying or failing to fulfill any commitment.

القوة القاهرة:
وهى بند شائع في العقود، لا يعد أي طرف مخالفًا أو مقصرًا في التزاماته وواجباته المنصوص عليها في العقد نتيجة لظروف خارجة عن نطاق سيطرته ولا يستطيع التحكم بها فالإنسان ليس لديه يد بها. ومنها أحداث القضاء والقدر التي تحدث فجأة من عند الله منها على سبيل المثال العواصف والزلازل والبراكين والفيضانات والحرب وأحداث الشغب والتمرد والعصيان والثورة وغيرها من الأمور والأحداث التي لا يمكن للإنسان التنبؤ بها وتوقعها لأنها في علم الغيب.

الحرز: هو الشاهد الصامت في معظم الدعاوى والقضايا، فهو لديه القدرة على تحويل مسار القضية تمامًا. فمن الممكن أن يوصل صاحبه إلى البراءة من ذنب ما أو الزج به إلى أقصى درجات العقوبة. قد يكون الحرز مواد مخدرة أو أسلحة أو ملابس أو أوراق أو أدوات مستخدمة في تنفيذ الجريمة، فهو الباب الخفي الذي من خلاله يتم إدانه المتهم أو براءته من ذنب ما ويكون في مكان وقوع الجريمة ويتم التحفظ عليه من قِبل النائب العام ليُعرض في المحكمة.

المتهم: هو كل شخص وجهت له السلطة القضائية التهم وأنسبتها إليه. فالمتهم برئ حتى تثبت إدانته بالدليل القاطع أو براءته. لدى المتهم الحق في توكيل محامٍ ليقوم بالدفاع عنه في التهم المنسوبة إليه، كما أن له الحق في معرفة نوعية التهم المنسوبة إليه سرقة كانت أو غيرها.

Attorney’s fees: The amount is paid to the lawyer by the client (maybe the claimant or the defendant in the case) for legal services and his defense for him in court. The fees may be accounted as hourly with a fixed amount of 5000 for example. Fees are received from the client as a result of the efforts of the attorney for submitting papers and collecting evidence to defend his proxy.

أتعاب المحاماة: هى الأموال التي يتلقاها المحامي من المتهم (أو من أحد أقاربه) مقابل الدفاع عنه في قاعة المحكمة وبذل قصارى جهده لتقديم وجمع الأدلة التي تثبت براءته من التهم الموجهه إليه. هذه الأتعاب يحصل عليها المحامي بالاتفاق مع المتهم قد تكون 500.000 أو أكثر حسبما يراه المحامِ مناسبًا لنوع القضية وتقديره لها وللمجهود الذي سيبذله للدفاع عنه.

Arbitration: is the process of resolving disputes, conflicts, and controversies arising between the parties outside the courts. The issue shall present to one arbitrator or more who issues a decision. It is an alternative solution for having recourse to the courts. In other words, without litigation. The dispute shall not resolve by the arbitrator without obtaining the consent of the parties.

التحكيم: هى آلية ووسيلة لحل النزاع القائم بين طرفين أو أكثر عن طريق محكم يتفق عليه كلا الطرفين. وهو حل بديل للجوء للمحاكم ورفع القضايا، حيث يسمح للطرفين حل نزاعهما وخلافهما خارج جدران المحكمة دون اللجوء للقضاء ويتم ذلك برضا وقبول الطرفين.
